1. About this policy

This policy explains how D & B Solutions Pty Ltd (ABN 11 079 092 729, ACN 079 092 729) of 163 Grey St, St George QLD 4487 (“we”, “us”, “our”) collects, holds, uses and discloses personal information. Personal information is information or an opinion about an identified person, or a person who is reasonably identifiable.

We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). [FRANKIE TO CONFIRM: Option A — keep this sentence only if the Privacy Act covers D & B]

As a small business, we may not be required to comply with the Privacy Act 1988 (Cth). We have still chosen to handle personal information in line with the Australian Privacy Principles (APPs), as described in this policy. [FRANKIE TO CONFIRM: Option B — keep this only if the small business exemption applies]

Because we supply customers in New Zealand, we also handle personal information about people in New Zealand in line with the New Zealand Privacy Act 2020. [FRANKIE TO CONFIRM: keep if D & B takes enquiries from or supplies NZ customers]

2. What personal information we collect

When you make an enquiry, ask for a quote or buy from us, we may collect:

  • your name, email address and/or phone number;
  • your business name, if you are enquiring for a business;
  • the delivery address, postcode or town;
  • details about your project, such as intended use, dimensions, facilities, toilet and change room requirements, services available on site, fencing length and height, gates and site access;
  • photos, plans or documents you choose to send us;
  • if you go ahead: billing, delivery and payment details [FRANKIE TO CONFIRM: how payments are taken, e.g. bank transfer or card through a payment provider. We do not need to store full card numbers];
  • notes of our conversations with you about the job.

We don’t ask for sensitive information (such as health information). Please don’t include it in your enquiry, or in photos and documents you send us.

When you visit our website, our website host automatically records standard technical information such as your IP address, browser type and the pages requested, to run and secure the site. [FRANKIE TO CONFIRM: website host, e.g. Netlify, and whether its server logs are kept]

3. How we collect it

We collect personal information directly from you: through the quote form on our website, by email, by phone, or in person.

Sometimes we receive information about you from someone else, for example a builder, site manager or family member who makes an enquiry on your behalf, or a transport company working on your job. If you give us information about another person, please let them know and point them to this policy.

You can browse our website without telling us who you are. To respond to an enquiry or prepare a quote, we need a way to contact you and the job location.

4. Cookies and analytics

Our website does not use advertising or analytics cookies, and does not track you across other websites. [FRANKIE TO CONFIRM: Option A — true for the current preview (no analytics, no tracking scripts)]

We use [FRANKIE TO CONFIRM: analytics tool, e.g. Netlify Analytics / Google Analytics] to understand how visitors use our website, such as which pages are viewed. [FRANKIE TO CONFIRM: whether it sets cookies, where data is stored, and how visitors can opt out] [Option B — use only if analytics is added]

5. Why we collect, hold and use it

  • to respond to your enquiry and discuss your requirements;
  • to prepare and send you a quote;
  • to arrange manufacture, supply and delivery if you go ahead;
  • to invoice you and manage payments;
  • to provide after-sales support and handle warranty or consumer-guarantee claims;
  • to keep records we are required to keep by law, for example for tax purposes;
  • to protect our website and business from fraud and misuse.

We don’t use computer programs to make decisions about you that significantly affect your rights or interests. [FRANKIE TO CONFIRM: true unless, for example, automated credit or eligibility checks are used]

6. Marketing

We don’t send marketing emails or messages. We will only contact you about your enquiry or job. [FRANKIE TO CONFIRM: Option A]

With your consent, we may send you occasional updates about our products. Every marketing email or SMS will identify us and include a free, easy way to unsubscribe. You can also opt out at any time by contacting us. We don’t sell, rent or trade personal information. [FRANKIE TO CONFIRM: Option B — use only if marketing is sent]

7. Who we disclose it to

We only share personal information as needed to deal with your enquiry or job, or where the law requires or allows it. This may include:

  • people who help us deliver your job, such as [FRANKIE TO CONFIRM: e.g. manufacturers/suppliers, transport and crane contractors, electricians or plumbers];
  • service providers that host our website, process our web forms and provide our email: [FRANKIE TO CONFIRM: website host, e.g. Netlify, Inc.; form processor, e.g. Netlify Forms; email provider, e.g. Microsoft 365 / Google Workspace];
  • our accountant, bookkeeping or payment providers [FRANKIE TO CONFIRM: e.g. accounting software provider];
  • government bodies or others where required or authorised by law.

We don’t sell personal information.

8. Overseas disclosure

Some of our service providers store data on servers outside Australia. Based on the providers we use, your information may be held in or accessed from [FRANKIE TO CONFIRM: countries, e.g. the United States for the website host and form processor, and wherever the email provider stores mail].

If your job is in New Zealand, we may share your details with transport companies or other contractors in New Zealand so we can deliver it. [FRANKIE TO CONFIRM: whether NZ contractors are used]

Where we send personal information overseas, we take reasonable steps to make sure it is protected, for example by using reputable providers with appropriate security and privacy commitments.

9. Storage, security and retention

We hold personal information in electronic form [FRANKIE TO CONFIRM: e.g. in our email system, accounting software and job files] and, for some jobs, on paper at our office. We take reasonable steps to protect it from misuse, interference and loss, and from unauthorised access, change or disclosure. These include password-protected accounts, limiting access to staff who need it, and using providers that encrypt data in transit.

We keep enquiry and quote records for [FRANKIE TO CONFIRM: e.g. 2 years if you don’t go ahead], and customer and job records for [FRANKIE TO CONFIRM: e.g. at least 5 years for tax records]. When we no longer need information, and are not required by law to keep it, we take reasonable steps to destroy or de-identify it.

10. Accessing and correcting your information

You can ask to see the personal information we hold about you, and ask us to correct it if it is wrong, out of date or incomplete. Contact us using the details below. We will respond within a reasonable time, usually within 30 days. We won’t charge you for making a request. If we refuse access or correction, we will tell you why in writing (unless that would be unreasonable) and how you can complain.

11. Data breaches

If a data breach involving your personal information is likely to cause you serious harm, we will notify you and the relevant regulator where the law requires it: in Australia, the Office of the Australian Information Commissioner (OAIC) under the Notifiable Data Breaches scheme [FRANKIE TO CONFIRM: applies only if the Privacy Act covers D & B — see Option A above]; in New Zealand, the Office of the Privacy Commissioner.
